Terms & Conditions

The terms governing your use of the NOW Services platform, including the role of independent service providers, payments, subscriptions and liability.

1. Acceptance of These Terms

These Terms and Conditions (“Terms”) govern your access to and use of the NOW Services website, web application and mobile applications (collectively, the “Platform”). By creating an account, accessing the Platform, requesting a service, providing a service, making a payment or otherwise using the Platform, you agree to these Terms.

If you do not agree to these Terms, you must not use the Platform.

2. What NOW Services Does

NOW Services operates as a third-party technology platform that connects customers with independent service providers. NOW Services is not the provider, contractor, plumber, technician, tradesperson or other professional performing the service unless expressly stated otherwise.

NOW Services provides the technology and marketplace through which customers and service providers may find one another, communicate, arrange services and, where applicable, process payments.

3. Independent Service Providers

Service providers using NOW Services are independent service providers. They are responsible for their own qualifications, licences, registrations, insurance, equipment, pricing, quotations, workmanship, conduct and compliance with applicable laws.

Customers are responsible for considering the information available about a service provider and for confirming the scope, price and requirements of a service before work begins.

4. Service Provider Work and Liability

To the maximum extent permitted by applicable law, NOW Services is not responsible for the actual work performed by an independent service provider, including poor workmanship, incomplete work, defective work, negligence, delays, failure to perform, misconduct or failure to meet an agreed specification.

This includes claims relating to damage to movable or immovable property, loss, economic loss, personal injury or other harm arising from the service provider’s acts or omissions, to the extent that applicable law permits such limitation.

Any claim concerning the quality, safety, completion, workmanship or consequences of work performed by a service provider should be directed to the service provider who performed the work. NOW Services may refer the claim to the relevant service provider and may assist with communication or support, but does not thereby assume responsibility for the service provider’s work.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under South African law.

5. Customer Complaints and Disputes

Customers should report service-related complaints to NOW Services where they require assistance. NOW Services may request photographs, quotations, invoices, messages, proof of payment and other information to understand the complaint.

Where appropriate, NOW Services may facilitate communication between the customer and service provider. The underlying service dispute remains primarily between the customer and the service provider, subject to any rights and remedies required by law.

6. Quotes, Prices and Scope of Work

Service providers are responsible for the accuracy of their quotations, prices, descriptions and scope of work. Any change to the agreed scope or price should be agreed between the customer and service provider before additional work is performed, where reasonably possible.

NOW Services does not guarantee that a quotation is accurate, complete or competitive.

7. Accounts and User Responsibilities

Users must provide accurate information when creating an account and must keep login credentials confidential. Users must not impersonate another person, create fraudulent accounts, misuse another user’s information, or use the Platform for unlawful purposes.

Users are responsible for activity conducted through their accounts unless they can demonstrate that the activity was unauthorised and could not reasonably have been prevented by them.

8. Provider Subscription Plans and Auto-Renewal

Service providers may be required to select and pay for a subscription plan before completing provider onboarding or accessing provider functionality.

A selected subscription is for the full period purchased. Cancellation does not terminate the current paid period or automatically create a refund for unused time, except where required by law or approved by NOW Services.

Subscriptions may automatically renew at the end of the selected period. Providers must cancel before the next renewal date if they do not want the subscription to renew. Once renewed, the new subscription period applies, subject to applicable law.

9. Payments and Third-Party Payment Providers

Payments may be processed through third-party payment providers such as PayFast or other payment services made available by NOW Services. Payment processing may be subject to the payment provider’s own terms, privacy notices and security procedures.

NOW Services does not store payment-card credentials unless expressly stated. Users must provide accurate payment information and must not use payment methods without authorisation.

10. Refunds and Cancellations

Refunds and cancellations are governed by the NOW Services Refund & Cancellation Policy, which forms part of these Terms.

Where the underlying service was performed poorly, incompletely or unsatisfactorily, responsibility for any service-related refund or remedy rests with the relevant service provider, subject to applicable law. NOW Services may assist with the customer’s claim but is not the party that performed the service.

11. Prohibited Conduct

Users may not use the Platform to commit fraud, harass or threaten others, upload unlawful or harmful content, interfere with Platform security, gain unauthorised access, scrape or misuse data, manipulate ratings or reviews, or use the Platform for any unlawful purpose.

12. Reviews, Ratings and Content

Users may be permitted to submit ratings, reviews, photographs and other content. Users remain responsible for the content they submit and must not submit defamatory, fraudulent, unlawful or misleading material.

NOW Services may remove content that violates these Terms or applicable law.

13. Intellectual Property

The NOW Services name, branding, software, designs, text, graphics and other Platform content are owned by or licensed to NOW Services and may not be copied, modified, distributed or commercially exploited without permission, except where permitted by law.

14. Platform Availability

NOW Services aims to keep the Platform available and secure but does not guarantee uninterrupted, error-free or continuously available access. Maintenance, outages, third-party services, network failures and other events may affect availability.

15. Limitation of Liability

To the maximum extent permitted by applicable law, NOW Services will not be liable for indirect, consequential, incidental or special loss arising from the acts or omissions of independent service providers or from the use of services arranged through the Platform.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

16. Indemnity

To the extent permitted by law, a user agrees to indemnify NOW Services against reasonable claims, losses, damages, costs and expenses arising from the user’s unlawful use of the Platform, breach of these Terms, fraud, or infringement of another person’s rights.

17. Suspension and Termination

NOW Services may suspend or terminate an account where reasonably necessary for security, fraud prevention, unlawful conduct, serious breaches of these Terms or protection of users and the Platform. Where appropriate, users may be given an opportunity to address the issue.

18. Privacy

NOW Services processes personal information in accordance with its Privacy Policy and applicable South African data-protection law, including POPIA. By using the Platform, you acknowledge that your information will be processed as described in the Privacy Policy.

19. Changes to These Terms

NOW Services may update these Terms from time to time. Material changes will be made available through the Platform or website. Continued use after the updated Terms become effective constitutes acceptance, to the extent permitted by law.

20. Governing Law and Disputes

These Terms are governed by the laws of the Republic of South Africa. Nothing in these Terms prevents a consumer from exercising a right or remedy available under mandatory South African law.
